Welcome to Prodege Fightwear! By accessing or using our website, prodegefightwear.com (the "Site"), and by purchasing products from us, you agree to be bound by these Terms and Conditions. Please read them carefully.

1. General

  • Agreement: On purchasing any products from this website, these Terms and Conditions constitute and form part of a legally binding agreement between you ("you," "your," or the "customer") and Prodege Fightwear ("we," "us," "our").
  • Amendments: We reserve the right to amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site and purchase of products after any such amendments constitutes your acceptance of the updated Terms and Conditions.
  • Governing Law: These Terms and Conditions are governed by the laws of Victoria, Australia, and the Australian Consumer Law. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria.

2. Products and Orders

  • Product Descriptions: We endeavour to ensure that all product descriptions, images, and pricing on the Site are accurate. However, variations in colour, texture, and size may occur due to monitor settings, lighting, and the manufacturing process. Product images are for illustrative purposes only.
  • Availability: All products are subject to availability. While we strive to keep our stock levels accurate, in the event that an item you ordered is unavailable, we will notify you as soon as possible and offer an alternative, a store credit, or a full refund.
  • Pricing: All prices are listed in Australian Dollars (AUD) and include GST where applicable. Prices are subject to change without notice. The price charged will be the price displayed on the Site at the time of your order.
  • Order Acceptance: Your order constitutes an offer to purchase a product. All orders are subject to acceptance by us. We will confirm our acceptance by sending you an order confirmation email. A contract between us will only be formed when we send you this confirmation. We reserve the right to refuse any order for any reason, including but not limited to, product unavailability, errors in pricing or product description, or suspicion of fraudulent activity.
  • Payment: All payments must be made in full at the time of placing your order. We accept payment via Paypal and Stripe . Payment processing is handled by secure third-party payment gateways. We do not store your full credit card details.

3. Shipping and Delivery

  • Shipping Area: We currently only ship to addresses within Australia.
  • Shipping Costs: A flat shipping rate of $5 per item applies to all orders. Orders over $100 qualify for FREE shipping. Shipping costs will be added at checkout.
  • Delivery Times: Delivery times vary depending on your selected delivery address, the availability of your items, and the time of day you place your order. We aim to dispatch orders within 1-3 business days of receiving payment. Estimated delivery times are provided for guidance only and are not guaranteed. We are not liable for any delays in delivery caused by third-party shipping carriers or unforeseen circumstances.
  • Loss or Damage in Transit: While we take all reasonable care to ensure products are safely delivered, we are not responsible for items lost or damaged by third-party shipping carriers after they have left our premises. We provide tracked delivery services through Australia Post.  If your order is lost or damaged, please contact us within 7 days of the expected delivery date so we can assist you in lodging a claim with the carrier.

4. Returns, Refunds, and Exchanges

  • 30-Day Warranty: All products are covered by a 30-day warranty from the date of delivery against defects in materials and workmanship. Should a defect arise within this period, we will, at our discretion, repair or replace the product. As the products are used for fighting and martial arts, this warranty does not cover damage caused by misuse, accidents, unauthorised modifications, or normal wear and tear.
  • Change of Mind Returns: We understand that sometimes you might change your mind. We offer change of mind returns within 7 days of purchase, provided the item is:
    • Unworn, unwashed, and in its original condition with all tags attached.
    • In its original packaging.
    • Accompanied by proof of purchase (e.g., order confirmation email or receipt).
    • Please note: For hygiene reasons, the product will not be eligible for change of mind returns if the item does not meet all of the conditions above.  
  • Faulty Products: If you receive a faulty product, please contact us immediately at Info@prodegefightwear.com with details of the fault and photographic evidence if possible. We will guide you through the process of returning the faulty item. Upon assessment, if the product is deemed faulty, we will offer a repair, replacement, or refund in accordance with Australian Consumer Law.
  • Return Process: To initiate a return or exchange, please contact us at Info@prodegefightwear.com to obtain a Return Authorisation (RA) number and instructions. Returns sent without an RA number may not be processed.
  • Return Shipping:
    • For change of mind returns, the customer is responsible for their shipping cost of returning the product to us.  The customer is responsible for the cost of return shipping, which will be charged to the customer at a flat rate of $12 (inclusive of GST), which must be paid before the goods are return shipped. 
    • For faulty products, we will cover the cost of return shipping.
  • Refund Processing: Refunds will be processed to the original payment method within 7-10 business days of receiving the returned item and verifying its condition.

5. Intellectual Property

  • Copyright: All content on this Site, including text, graphics, logos, images, and product designs, is the property of Prodege Fightwear or its content suppliers and is protected by Australian and international copyright laws. You may not reproduce, distribute, display, or create derivative works of any content on this Site without our express written permission.
  • Trademarks: "Prodege Fightwear" and all associated logos and slogans are trademarks of Prodege Fightwear. You may not use these trademarks without our prior written consent.

6. User Conduct

  • Prohibited Activities: You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. Prohibited activities include, but are not limited to:
    • Attempting to gain unauthorized access to the Site or its systems.
    • Transmitting any harmful or malicious code, viruses, or other destructive programs.
    • Engaging in any form of data mining, scraping, or similar data gathering and extraction methods.
    • Impersonating any person or entity.
    • Falsely stating or otherwise misrepresenting your affiliation with a person or entity.
    • Posting or transmitting any unlawful, defamatory, obscene, or offensive material.
  • User Reviews and Comments: If the Site allows for user reviews or comments, you agree that any content you submit will not be illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable. We reserve the right (but not the obligation) to remove or edit any such content.

  • General: To the maximum extent permitted by law, Prodege Fightwear, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Site or the purchase of products from us.
  • Product Use: You acknowledge that our products are designed for specific uses (e.g., fightwear). You agree to use the products only for their intended purpose and in accordance with any provided care instructions. We are not liable for any injury, damage, or loss arising from the improper use or misuse of our products.
  • Website Availability: We do not guarantee that the Site will be available at all times or that it will be free from errors or viruses. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses, or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of the Site or to your downloading of any content from it.
